Planning to Marry Your U.S. Citizen Fiancé(e)? What You Should Know About the K-1 Visa

“I’m engaged to a U.S. citizen. What comes next?”

For many Filipinos engaged to a U.S. citizen, this question marks the beginning of an exciting but often confusing journey. While love may know no borders, immigration laws certainly do. If you are planning to marry your U.S. fiancé(e) and build your future together in the United States, the K-1 Fiancé(e) Visa is usually the first and most important step.

Understanding the K-1 Fiancé(e) Visa

The K-1 visa is a non-immigrant visa created specifically for the foreign fiancé(e) of a U.S. citizen. It allows you to enter the United States for the sole purpose of getting married.

Once your visa is approved and you arrive in the U.S., the law requires that the marriage take place within 90 days. This period is strict. The K-1 visa cannot be extended, and it is valid only for marriage to the U.S. citizen who filed the petition. If the marriage does not happen within the allowed timeframe, the foreign fiancé(e) must leave the United States.

After the wedding, the process does not end. The next step is applying for Adjustment of Status, which allows you to become a lawful permanent resident and eventually receive your Green Card.

Do You Qualify for a K-1 Fiancé(e) Visa?

Being engaged to a U.S. citizen is an important first step, but it does not automatically guarantee eligibility for a K-1 fiancé(e) visa. The U.S. government carefully reviews each application to confirm that the relationship is genuine and that both partners are legally and financially prepared for marriage.

Here are the key qualifications USCIS considers:

✔️The petitioner must be a U.S. citizen.
Only U.S. citizens are allowed to file a K-1 fiancé(e) petition. Lawful permanent residents or Green Card holders are not eligible for this visa category.

✔️Both partners must be legally free to marry.
Any previous marriages, whether in the Philippines, the United States, or elsewhere, must be officially and legally ended before the application is filed.

✔️The couple must have met in person within the last two years.
USCIS requires proof that the relationship is real and ongoing. Meeting in person within the past two years is a core requirement, with very limited exceptions. Supporting evidence may include photos together, conversation logs, accommodation receipts, or proof of shared transactions.

✔️The U.S. citizen must meet the income requirement.
As of January 2026, a U.S. citizen petitioner with no children must earn at least $26,437 per year. This requirement helps show that the fiancé(e) will be financially supported and will not rely on public assistance.

✔️Both parties must pass background checks.
Security and criminal background checks are part of the process. Serious criminal convictions, especially those involving fraud, violence, or immigration violations, may affect eligibility.

Meeting these requirements does not guarantee approval, but it does mean you meet the basic qualifications needed to move forward with a K-1 fiancé(e) visa application.

How Long Does the Process Take?

The K-1 visa process is not immediate. On average, applicants can expect a timeline of 8 to 12 months, although this may vary.

Delays often occur because of missing documents, errors in forms, embassy interview availability, or extended background and security checks conducted by U.S. authorities. For this reason, it is strongly advised to start early and prepare carefully. A well-organized application can help reduce delays and stress.
